What is a Gift in Will?
A gift in will (or ‘bequest’) is a gift to a charitable organisation left in a will. It can be a gift of cash, property, shares or other items of value. The gift can be for a specified amount, a percentage of the value of your estate, or the residue after your other gifts, taxes and debts have been fulfilled.
Pursuant to the Wills Act, all wills and codicils (a codicil is a document that amends, rather than replaces, a previously executed will) must be in writing, signed by the Testator, and attested by two witnesses in the presence of the Testator and each other.
As the formal requirements for making a valid will must be strictly adhered to, it is recommended that you have your will drawn up professionally by a solicitor.
How to include a gift in your will
Everyone should have a will as it gives you the power to choose how your assets can benefit your loved ones and the world you leave behind.
Making or updating a will is simple - just ask you solicitor to include the type of gift of your choosing. Set out below is some suggested wording, however it is recommended that you seek professional legal advice.
